Poseq

Posseq ( Hebrew , IPA : / po seq /, pl. Posqim, ) is the term of (Jewish law) for a "decider," a scholar with the authority to make a decision of law or in a case that has not yet been found or where it is not possible to decide based on the previous authorities.

The din pisqei are generally recorded in the literature of responsa ( ).

The process psiqa

A posseq emitting PSAQ Din must be based on a careful analysis of the underlying legal principles, and a careful study of how to apply these principles in accordance with previous decisions. A posseq which should make a decision now must be versed in rabbinic literature and expert in Talmud.

The analysis of legal principles include:

  1. an initial study of Talmudic souguiyot appropriate, with their comments, especially those of Rashi and Tosafists , located in the Middle Ages;
  2. monitoring the evolution of these souguiyot in medieval authorities (the Rishonim ), especially Moses Maimonides , the Rosh , the Tower and the Shulchan Aruch ;
  3. Finally, a careful analysis of the works of Aharonim (authorities from 1500 until today), discussing the Halakha, as in the Shulchan Aruch comsigne.

The PSAQ Din must be an application of these principles and take into account legal precedents contained in the responsibility.
